Terms of Service
Effective Date: June 1, 2026
Agreement to Terms
These Terms of Service ("Terms") govern the use of services provided by JAC Landcare LLC ("JAC Landcare," "Company," "we," "our," or "us"). By requesting, scheduling, accepting, or paying for services, you agree to be bound by these Terms.
Services
JAC Landcare provides landscaping, lawn maintenance, mowing, mulching, planting, drainage, hardscaping, fencing, snow and ice management, property maintenance, and related outdoor services.
All services are subject to availability, weather conditions, site conditions, and material availability.
Estimates & Proposals
All estimates and proposals are valid for thirty (30) days unless otherwise stated.
Material costs, fuel costs, disposal fees, and supplier pricing may change after a proposal is issued. JAC Landcare reserves the right to revise pricing for projects not yet accepted.
Deposits
Projects exceeding $2,500 may require a deposit before scheduling.
Unless otherwise specified, construction and installation projects require a 50% deposit prior to mobilization, with the remaining balance due upon completion.
Scheduling & Weather
Project schedules are estimates only and are subject to weather, material availability, equipment breakdowns, labor availability, and other unforeseen circumstances.
JAC Landcare shall not be liable for delays beyond its reasonable control.
Property Access
Customers are responsible for providing reasonable access to the property and work areas.
Additional charges may apply if access restrictions, locked gates, parked vehicles, pets, utilities, or other obstacles interfere with work.
Site Conditions
Pricing is based upon visible site conditions at the time of estimating. Should concealed conditions, buried debris, unsuitable soils, concrete, rock, roots, utilities,
or other unforeseen conditions be encountered, additional work shall be billed at current labor, equipment, and material rates.
Underground Utilities
Customers are responsible for disclosing any known underground utilities, irrigation systems, invisible fences,
drainage systems, low-voltage wiring, septic systems, or other underground improvements.
While reasonable precautions are taken, JAC Landcare is not responsible for damage to unmarked or undisclosed underground installations.
811 Dig will be called prior to all dig operations.
Change Orders
Any customer-requested additions, deletions, or modifications to the agreed scope of work may require a written change order and may result in additional charges and schedule adjustments.
Lawn & Landscape Services
Mowing services are provided on a weekly basis unless otherwise agreed.
Overgrown properties may incur additional charges for double cuts, trimming, cleanup, or restoration.
Plant material, trees, shrubs, and sod require proper watering and maintenance by the customer after installation.
Fuel Surcharge
If the average local retail gasoline price exceeds the following thresholds, JAC Landcare reserves the right to apply a temporary fuel surcharge per service:
$4.50–$4.99 per gallon: Up to $3.50
$5.00–$5.49 per gallon: Up to $6.50
$5.50 per gallon and above: Up to $10.50
Any surcharge will be clearly identified on invoices.
Disposal & Dump Fees
Pricing is based on current disposal, landfill, composting, and dump fees.
Should disposal costs increase significantly after a proposal is accepted, JAC Landcare reserves the right to pass through documented increases directly related to the project.
Payment Terms
Payment is due upon receipt unless otherwise agreed to in writing by JAC Landcare. Any invoice not paid within seven (7) calendar days of the invoice date shall be subject to a recurring late fee equal to ten percent (10%) of the outstanding balance per week, assessed every seven (7) days until paid in full.
Approved commercial accounts shall be invoiced on Net 30 payment terms, with payment due thirty (30) calendar days from the invoice date unless otherwise agreed to in writing. Any invoice not paid within seven (7) calendar days after its due date shall be subject to a recurring late fee equal to ten percent (10%) of the outstanding balance per week, assessed every seven (7) days until paid in full.
Customer agrees to pay all collection costs, reasonable attorney's fees, court costs, collection agency fees, and other expenses incurred in recovering delinquent balances, where permitted by applicable law.
JAC Landcare reserves the right to suspend or terminate current or future services until all outstanding balances, including applicable late fees, have been paid in full.
Mechanic's Lien Rights
To the fullest extent permitted by Ohio law, JAC Landcare reserves the right to file a mechanic's lien or any other legal claim against the property for unpaid labor, materials, equipment, services, interest, costs, and fees associated with work performed.
Warranty
JAC Landcare warrants installation workmanship for one (1) year unless otherwise stated in writing.
This warranty does not cover:
Plant material or transplant survival
Improper watering
Drought
Excessive rainfall
Soil conditions
Disease
Insects
Animal damage
Acts of God
Freeze or frost damage
Wind damage
Damage caused by other contractors or third parties
Vehicle damage
Lack of routine maintenance
Replacement plants and materials are not included unless specifically stated.
Photography, Video & Marketing Content
JAC Landcare reserves the right to photograph, film, record video, capture drone footage (where permitted by law), and document projects before, during, and after completion.
The customer grants JAC Landcare permission to use such photographs, videos, testimonials, reviews, project descriptions, and related content for marketing, advertising, social media, website content, portfolio displays, promotional materials, and other business purposes without compensation.
JAC Landcare will make reasonable efforts to avoid displaying personal identifying information such as street numbers, license plates, or private information when practical; however, complete anonymity cannot be guaranteed.
Customers who do not wish to have their project photographed or filmed must submit a written request prior to the start of work. JAC Landcare reserves the right to decline such requests when documentation is required for quality control, insurance, warranty, or project recordkeeping purposes.
Cancellations
Customers may cancel scheduled services by providing reasonable notice.
Deposits may be forfeited if materials have been ordered, labor has been scheduled, or project preparation has begun.
Due to the significant labor, scheduling, equipment allocation, and route planning involved with seasonal cleanup services, any spring cleanup canceled on the scheduled service date may be subject to a cancellation fee of up to $500.
Customers who repeatedly schedule and cancel services may be declined future service at the sole discretion of JAC Landcare.
Hardscape & Construction Project Cancellation
Hardscape, drainage, fencing, retaining wall, patio, walkway, excavation, and other construction-related projects canceled within seven (7) calendar days of the scheduled start date shall be subject to a cancellation fee equal to twenty-five percent (25%) of the accepted project value.
This fee is intended to compensate for labor scheduling, project preparation, material procurement, equipment reservations, administrative expenses, and lost scheduling opportunities.
Any deposits paid may be applied toward the cancellation fee, with any remaining balance due immediately upon cancellation.
Right to Refuse Service
JAC Landcare reserves the right to refuse, discontinue, or terminate service at its sole discretion for unsafe working conditions, abusive behavior, non-payment, fraudulent activity, inaccessible work areas, or any other circumstance that reasonably prevents safe or professional completion of the work.
Force Majeure
JAC Landcare shall not be liable for delays or failure to perform caused by events beyond its reasonable control, including but not limited to severe weather, natural disasters, labor shortages, supply chain disruptions, government actions, utility interruptions, equipment failures, or other unforeseen circumstances.
Limitation of Liability
JAC Landcare's liability shall be limited to the amount paid for the specific service giving rise to the claim.
Under no circumstances shall JAC Landcare be liable for indirect, incidental, special, consequential, or punitive damages.

By providing your phone number or email address, you consent to receiving communications related to estimates, scheduling, billing, project updates, and promotional offers.
Message and data rates may apply.
You may opt out of marketing communications at any time.
Acceptance
By requesting an estimate, approving a proposal, scheduling services, electronically accepting a quote, signing an agreement, or allowing JAC Landcare to commence work, the customer acknowledges that they have read, understood, and agree to these Terms of Service.
Entire Agreement
These Terms, together with any accepted estimate, proposal, contract, or written agreement issued by JAC Landcare, constitute the entire agreement between the parties and supersede all prior discussions, negotiations, or representations.
Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Ohio.
Dispute Venue
Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in Warren County, Ohio, unless otherwise required by applicable law.
Changes to Terms
JAC Landcare reserves the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date.
